The CAN-SPAM Act, or Controlling the Assault of Non-Solicited Pornography and Marketing Act, was passed by Congress in 2003 and signed into law by President George W. Bush in 2003. The CAN-SPAM Act is a US law that governs commercial emails and other messages from commercial entities. The CAN-SPAM Act applies almost exclusively to "commercial electronic mail messages". It makes no exception for business-to-business email, but does exempt transactional and relationship messages.
The CAN-SPAM Act has the following features:
Rules for commercial messages: The CAN-SPAM Act sets rules for commercial messages, including subject lines, disclosures, and headers.
Requirements for commercial messages: The CAN-SPAM Act establishes requirements for commercial messages, including defining the primary purpose of an electronic mail message.
Rights for recipients: The CAN-SPAM Act gives recipients the right to have you stop emailing them and spells out tough penalties for violations.
Enforcement: The FTC enforces the CAN-SPAM Act and the accompanying CAN-SPAM Rule
The act‘s key points include:
- Content compliance:
- Use an accurate "From" line
- Use a relevant subject line that relates to the email‘s content
- Include a legitimate physical address of the publisher or advertiser
- If the content is adult, use an adult label
- Have at least one sentence, cannot be null, and cannot contain a false header
- Sending behavior compliance:
- Clearly state that the message is an ad
- Provide an option for recipients to unsubscribe
- Honor unsubscribe requests within 10 business days
- Use clear "From," "To," and "Reply to" language that accurately reflects who you are
- Other key points include:
- Don‘t use false or misleading header information
- Don‘t use deceptive subject lines
- Identify the message as an ad
- Tell recipients where you‘re located
